Real Estate, Land Use & Environmental Law

Real estate transactions require appropriate entity selection, careful drafting, thorough knowledge of technical legal principles, and imaginative solutions for client objectives. Our lawyers understand complex title issues and regulatory requirements, and we have the training and experience to successfully complete your project.

We advise clients in a broad range of real estate matters, including:

  • Land acquisition

  • Zoning

  • Subdivision control

  • Environmental compliance and permitting

  • Financing and securitization of real estate investments

  • Construction projects

  • Specialized tax treatment

  • Leasing and sales

  • Tax abatements

Our real estate lawyers represent commercial lenders and borrowers, developers and homeowners. We advise on residential, commercial and industrial subdivisions, office parks, hotels and residential and commercial condominiums. We also represent both landlords and tenants in commercial leasing.

In addition to our commercial real estate practice, our real estate attorneys also have a substantial residential practice, representing buyers and sellers of primary and second homes throughout Berkshire County and beyond.

Our land use and zoning lawyers frequently represent clients before local boards, such as conservation commissions and planning and zoning boards. We appear before the state Appellate Tax Board, in appeals before state administrative agencies, such as the Massachusetts Department of Environmental Protection, and with our litigation department, we represent our clients in state and federal courts.
